Loss of consortium in wrongful death claims

What is loss of consortium?

Loss of consortium, also often referred to as loss of affection and loss of companionship, is a legal phrase to describe the loss experienced by the spouse or close relative of a person who passed away in an accident. It provides a way for a grieving person to claim damages for the loss that they experienced specifically.

What needs to be proven to successfully gain damages through loss of consortium?

First, you will need to prove that the party you are claiming damages from are to blame for your loved one's death. After this has been established, you should also be able to show that you had a stable and loving relationship with the person who passed away.
