Confidential Settlement
Successful resolution of a Negligent Security case against a well-known convenience store chain through Mediation. Our client was a young father of two who was assaulted by young criminals who used the convenience store parking lot as a nighttime gathering place during the warmer months. We were able to prove through thorough investigation and expert testimony that the convenience store had prior knowledge of the dangerous propensities of these people and negligently ended their contracted private security officers on Labor Day, despite the continued use of their parking lot by these criminals well into the Fall.
Policy Limit Settlement
Successful resolution of a Dog Bite case for the Defendant’s entire insurance policy limits, through Mediation. Our client was an elementary school student who went to a neighbor’s home to play. Unbeknownst to our client, the neighbor had recently adopted a Pit Bull. The Pit Bull bit our client without provocation causing injuries that required multiple surgeries and resulted in permanent scarring.
Million Dollar Jury Verdict
Successful prosecution of a motor vehicle case against both the negligent driver’s insurance carrier AND our client’s own “Underinsured Motorist” insurance carrier. After proving the 100% responsibility of the negligent driver for the collision a trial was held to determine the validity of the insurance carriers’ claim that our client exaggerated his injuries. Following a full trial involving medical experts and “secret” surveillance, the jury disregarded the insurance companies’ arguments and awarded our client more than One Million Dollars in compensation for his very serious and very real injuries.
Confidential Settlement
Successful resolution, through Mediation, of a client’s Slip and Fall accident due to the negligent snow removal and deicing efforts of a commercial property owner and their snow removal contractor. Our client suffered severe neck and shoulder injuries when walking from her car to her workplace the morning following a snowstorm. Numerous legal issues needed to be overcome including the reasonableness of the commercial landowner’s response to the snowstorm, the dissolution of the uninsured snow removal contractor and the extent of the client’s injuries.
Confidential Settlement
Successful resolution of a multi vehicle intersection collision during an electrical blackout. Our clients were two children who were passengers in this two-car intersection accident. Both drivers claimed they were not responsible as the traffic control signal was rendered inoperable due to a power outage and neither had a RED traffic signal controlling their direction of travel. Our young clients suffered significant neck, back, knee and Mild Traumatic Brain injuries in the collision. We successfully argued that BOTH drivers were at fault for their actions by proceeding into an “uncontrolled intersection” without taking sufficient caution to make sure they could do so safely. In addition, through investigation we were able to identify and trace the cause of the power outage to an unrelated motor vehicle accident several miles away. This allowed us to obtain additional financial contribution, to our client’s award, from a third insurance carrier.
Worker’s Comp:
Total Disability Trial verdict
The petitioner was a parcel delivery driver who alleged a lifting episode causing lumbar injury which ultimately led to psychiatric disorder. The employer disputed the necessity of lumbar fusion surgery and the psychiatric diagnosis’ relation to the injury. The injured worker and two evaluating physicians testified in support of the claim. The employer produced two physicians to dispute the claim.
Disability Settlement
The petitioner alleged work-related injury to the neck and shoulder. The claim was denied throughout the period of medical treatment. The employer ultimately accepted responsibility for the accident and paid temporary disability, medical and permanency benefits with a finding of 65% partial total disability.
Total Disability Resolution
Petitioner filed a verified petition to join the 2nd Injury Fund alleging total disability. The DAG handling the fund disagreed with the petition. After testimony was offered in support, the DAG accepted the claim and consented to entry of an Order for Total Disability.
