What Types Of Benefits Can I Receive?

In New Jersey, injured workers are entitled to three types of benefits:

  • Medical benefits Your employer’s insurance company selects your medical provider. If you are unhappy with your care, we can file a motion for medical treatment seeking the care and treatment you need to heal.
  • Permanent disability benefits If a workplace accident left you with a permanent injury, you may be entitled to permanent disability benefits even if you are able to return to work.
  • Temporary disability benefits – If a workplace injury takes you off the job for more than seven days, you are entitled to receive temporary workers’ compensation benefits.

If you were permanently disabled and are unable to work due to a job-related injury, you may be entitled to a total disability award.

When Will I Get My Check?

If you’ve been injured at work, file your workers’ comp claim as soon as possible. It generally takes up to two weeks to receive temporary benefits. If your employer delays your benefits for more than 30 days, you may be able to seek additional compensation.

In New Jersey, injured workers are entitled to medical benefits and compensation for a portion of their lost wages. In general, workers can expect to receive temporary disability benefits reflecting 70% of their average weekly wage. The process used to determine a worker’s average weekly wage can be complex.
