When Will My Workers’ Compensation Benefits Kick In?

Seven days: In New Jersey, you must be unable to work for a full week (seven days) in order to be eligible for temporary disability benefits, though the seven days do not need to be consecutive. However, there is no waiting period for permanent disability benefits.

Two weeks: The amount of time most workers can expect to wait after an injury before receiving temporary benefits, barring any delay on the part of their employer or insurance company.

Thirty days: After which, a delay caused by the employer or insurance company is considered unreasonable.

Two years: The statute of limitations in New Jersey. Employees must file a formal complaint within two years of the injury (or the date of the last payment, depending on which is later).
